The Ministry for the Ecological Transition and the Demographic Challenge (MITECO) has launched the public consultation period for the <a target=\"_blank\" rel=\"noopener\" href=\"https:\/\/www.miteco.gob.es\/es\/energia\/participacion\/2026\/detalle-participacion-publica-k-851.html\">draft Royal Decree on the sustainability of data centers.<\/a> <\/p>\n\n<p class=\"wp-block-paragraph\">This proposed regulation aims to govern the technical requirements for Data Processing Centers, aligning them with decarbonization goals and in accordance with the government strategy on <a target=\"_blank\" rel=\"noopener\" href=\"https:\/\/www.lamoncloa.gob.es\/consejodeministros\/resumenes\/Documents\/2026\/240226-soberania-digital.pdf\">Digital Sovereignty and infrastructure resilience (La Moncloa).<\/a><\/p>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\"><strong>Global Context: Why Spain is taking action to prevent energy bottlenecks<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The need to regulate access to and sustainability of data centers addresses a global challenge. While a Data Processing Center can be built within 18 to 24 months, a power plant or electricity transmission infrastructure requires 5 to 10 years to deploy. If digital demand connects without accompanying coordinated power generation, the resulting imbalance drives up system costs.  <\/p>\n\n<p class=\"wp-block-paragraph\">Europe and the U.S. have already shown precedents of grid and regulatory saturation:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Ireland: <\/strong>After data center electricity consumption exceeded 20% of the national total, a moratorium was implemented in Dublin in 2021. In December 2025, it was mandated that all new grid connections must provide dispatchable generation or on-site energy storage. <\/li>\n\n\n\n<li>The Netherlands: Amsterdam banned new data centers in 2019, restricting hyperscalers to just two municipalities in the northern part of the country.<\/li>\n\n\n\n<li><strong>United States:<\/strong> Has accumulated moratoria across more than 30 states and over 200 municipalities, notably including New York&#8217;s moratorium in July 2026 and the freezing of grid connections in Texas pending audits.<\/li>\n<\/ul>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\"><strong>What Type of Data Centers Are Arriving in Spain? Training vs. Inference  <\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Accurately sizing the grid based on the country&#8217;s actual needs is essential:<\/p>\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Training Data Centers (Large AI Clusters):<\/strong>\n<ul class=\"wp-block-list\">\n<li>Require facilities capacity in the hundreds of megawatts or gigawatts, running GPUs continuously for weeks or months.<\/li>\n\n\n\n<li>They do not need to be located near the end user and are heavily concentrated in the U.S. and China (~80% of the global market according to the IEA).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Inference and Cloud Data Centers (The Focus in Spain):<\/strong>\n<ul class=\"wp-block-list\">\n<li>They are designed for the daily use of already-trained models and cloud services.<\/li>\n\n\n\n<li>They require proximity to the user and to data, putting estimated demand in Spain in the range of 3 to 4 GW (rather than tens of GW).<\/li>\n\n\n\n<li>This is the priority segment targeted by the regulations on Digital Sovereignty.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Key Points of the Draft Regulation in Spain<\/strong><\/h3>\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Energy and Water Efficiency Requirements: <\/strong>The draft decree requires strict monitoring of key metrics such as <em>Power Usage Effectiveness<\/em> <strong>(PUE)<\/strong> and <em>Water Usage Effectiveness<\/em> <strong>(WUE)<\/strong>.
