Spain’s New Regulatory Landscape for Data Centers: Sustainability, Digital Sovereignty, and Market Reality

The Data Processing Center (DPC) sector is going through a defining moment in Spain. The Ministry for the Ecological Transition and the Demographic Challenge (MITECO) has launched the public consultation period for the draft Royal Decree on the sustainability of data centers.

This proposed regulation aims to govern the technical requirements for Data Processing Centers, aligning them with decarbonization goals and in accordance with the government strategy on Digital Sovereignty and infrastructure resilience (La Moncloa).

Global Context: Why Spain is taking action to prevent energy bottlenecks

The need to regulate access to and sustainability of data centers addresses a global challenge. While a Data Processing Center can be built within 18 to 24 months, a power plant or electricity transmission infrastructure requires 5 to 10 years to deploy. If digital demand connects without accompanying coordinated power generation, the resulting imbalance drives up system costs.

Europe and the U.S. have already shown precedents of grid and regulatory saturation:

  • Ireland: After data center electricity consumption exceeded 20% of the national total, a moratorium was implemented in Dublin in 2021. In December 2025, it was mandated that all new grid connections must provide dispatchable generation or on-site energy storage.
  • The Netherlands: Amsterdam banned new data centers in 2019, restricting hyperscalers to just two municipalities in the northern part of the country.
  • United States: Has accumulated moratoria across more than 30 states and over 200 municipalities, notably including New York’s moratorium in July 2026 and the freezing of grid connections in Texas pending audits.

What Type of Data Centers Are Arriving in Spain? Training vs. Inference

Accurately sizing the grid based on the country’s actual needs is essential:

  1. Training Data Centers (Large AI Clusters):
    • Require facilities capacity in the hundreds of megawatts or gigawatts, running GPUs continuously for weeks or months.
    • They do not need to be located near the end user and are heavily concentrated in the U.S. and China (~80% of the global market according to the IEA).
  2. Inference and Cloud Data Centers (The Focus in Spain):
    • They are designed for the daily use of already-trained models and cloud services.
    • They require proximity to the user and to data, putting estimated demand in Spain in the range of 3 to 4 GW (rather than tens of GW).
    • This is the priority segment targeted by the regulations on Digital Sovereignty.

Key Points of the Draft Regulation in Spain

  1. Energy and Water Efficiency Requirements: The draft decree requires strict monitoring of key metrics such as Power Usage Effectiveness (PUE) and Water Usage Effectiveness (WUE). It promotes the adoption of low-consumption cooling technologies, waste heat recovery, and the reduction of the water footprint through closed-loop systems or non-potable water.
  2. Additionality and Renewable Energy Integration: To address high electricity consumption without straining the grid, the proposal requires additionality in renewable supply, mandating that projects be supported by new clean generation capacity or energy storage.
  3. Operational Resilience and Digital Sovereignty: The regulation reinforces security and service continuity, steering growth toward inference and storage infrastructure that guarantees technological autonomy without overburdening electricity system tariffs.
  4. Environmental Traceability and Transparency: Operators will be required to register and report their consumption and emissions metrics to ensure rigorous energy audits for management authorities.
